Louisiana Appellate Attorneys

Babcock Law Firm has a well respected and immensely successful appellate practice. Our attorneys boast of roughly 20 published opinions in the last several years. Sophisticated, in-depth legal analysis is critical to success in the appellate arena. Our attorneys provide that legal analysis along with highly specialized case management, the end result of which is tremendously high quality briefs and effective oral arguments. The aim of our appellate practice is to produce arguments and briefs that are not only painstakingly researched, logically developed, and correctly attuned to particular courts and judges, but also highly readable and engaging to busy appellate judges.

We are frequently engaged by other attorneys and law firms to assist them in developing and planning an effective appellate strategy including drafting briefs and making oral arguments. We have tremendous flexibility in working with other counsel, and often can work on contingency. Our fees range from $4,000 to $75,000, or more, depending on the complexity of the subject matter and court in which the appeal is to be heard. Upon the client's request, we can create budgets that outline the services to be provided and estimate the time and costs.

Additionally, we can send an appellate attorney to accompany your trial counsel. In big cases it may behoove you to consider adding an appellate specialist to the trial team from the outset. The appellate specialist can identify key legal arguments, draft dispositive motions and motions in limine, and prepare proposed instructions that adequately preserve claims of instructional error. In our view, an attorney should be solely tasked with ensuring that arguments are properly preserved. This means making sure that key rulings are on the record, that proper instructions are submitted, and that objections to testimony are made at the proper time and on the proper grounds. After all is said and done, even the best appellate attorneys will struggle if the record is not properly preserved before it goes up.

Lastly, we'll let you know if your appeal has merit. “When you discover you are riding a dead horse, the best strategy is to dismount.” The Dakota Indians are often credited with this wisdom; however, it’s a fairly applicable principle when applied to appellate litigation. Regardless of the type of appeal or the area of law involved, our attorneys will give you a realistic opinion of the value of your appeal. In other words, we will let you know if we think you are riding a dead horse.
